Take-Two Law Enforcement Guidelines

Take-Two Interactive Software, Inc. is a global company headquartered in the United States of America whose group includes all Take-Two entities and labels, including Rockstar Games, 2K, Private Division, and Zynga (“Take-Two”). The information contained in these guidelines is subject to change without notice, takes effect from the Last Updated date set forth above, and does not constitute legal advice.

Take-Two is committed to complying with valid, lawful requests for information and orders to take action regarding user generated content (“UGC”) available in any of Take-Two’s products or services. The following guidelines are intended to assist government agencies, national authorities, regulatory bodies, European Commission designated trusted flaggers, and law enforcement (“Law Enforcement”) in submitting requests and orders to Take-Two in a manner that will enable Take-Two to expedite a response.

Note — these guidelines are only intended for use by Law Enforcement:

  • All civil legal requests for production or other civil legal process must be served on Take-Two’s corporate agent at the address listed below. Take-Two does not consent to legal service via email; sending documents by email is not effective service. However, to help expedite Take-Two’s response to validly served, effective legal process, please email a PDF courtesy copy of the documents served on Take-Two’s corporate agent to [email protected].

  • All consumer requests for general support or information should be directed to Customer Support in the first instance. General requests for customer support or information submitted to any of the email addresses listed below will be deleted without response. False, misleading, or bad faith use of the Law Enforcement request system by a consumer is a violation of our Terms of Service and may result in adverse action against your Account.

Take-Two collects and processes information regarding consumers of its products and services in accordance with its Privacy Policy. This information may differ depending on the label, product, service, or distribution platform used. Please read Take-Two’s Privacy Policy for more information on the type of information that Take-Two may have in respect of its consumers before submitting any legal service on Take-Two.

INFORMATION FOR UNITED STATES LAW ENFORCEMENT

Request to Preserve Information

Requirements:

1. Describe the information to be preserved with reasonable detail, including the relevant time period;

2. Submit on official letterhead and include a valid email address, telephone number, and contact name for correspondence; and

3. Ensure the request is signed by an authorized representative of the issuing Law Enforcement entity.

Note:

In response to a valid preservation request under applicable law, Take-Two will endeavor to preserve identified, responsive information for 90 days,which may be extended once for an additional 90 days upon request.

Request to Produce Information

Requirements:

• Basic user records (e.g. name, username, character names, email address, IP address, and connection records);

• Private user communications (less than 180 days old)

Valid subpoena issued in connection with an official criminal investigation (18 U.S.C. § 2703(c)(2)

Requirements:

• General records or information (e.g. friend lists, groups to which the consumer belongs);

• Private user communications (over 180 days old)

Valid court order (18 U.S.C. § 2703(d))

Emergency Requests — Danger of Death / Serious Physical Injury

Requirements:

1. Describe the grounds for the emergency, including any likelihood of imminent danger of death or serious physical injury;

2. Submit on official letterhead and include a valid email address, telephone number, and contact name; and

3. Ensure the request is signed by an authorized representative of the issuing Law Enforcement entity.

Note:

In the absence of a subpoena or court order, Take-Two is permitted but not required to disclose information and private user communications in response to a genuine emergency involving imminent danger of death or serious physical injury. We reserve sole discretion to determine whether the circumstances described support the need for emergency disclosure.

INFORMATION FOR EUROPEAN UNION AND OTHER NON-U.S. LAW ENFORCEMENT

All requests for information and orders to act that are issued by Law Enforcement outside the United States must be submitted in English and comply with applicable law. Before submitting a request to Take-Two, please confirm whether a mutual legal assistance request or letter rogatory is required in order to validly effect service on Take-Two

Digital Services Act (“DSA”)

Requirements —

Orders to Provide Information:

1. Direct the order to the relevant Take-Two legal representative;

2. Identify the issuing Law Enforcement entity you represent;

3. Identify the Take-Two product or service at issue;

4. Provide reasonably detailed information regarding the inquiry and the information sought to enable Take-Two to identify the specific consumer(s) in respect of which such information is sought (such as one or more usernames, account names, email addresses, unique device identifier, or other unique identifiers);

5. Identify the legal basis under EU or Member State law for the order;

6. Identify any relevant Law Enforcement entity to which information about the effect given to the order is to be provided;

7. Submit on official letterhead and include a valid email address, telephone number, and contact name; and

8. Ensure the request is signed by an authorized representative of the issuing Law Enforcement entity.

Requirements —

Illegal Content Notices:

1. Direct the order to the relevant Take-Two legal representative;

2. Identify the issuing Law Enforcement entity you represent;

3. Identify the Take-Two product or service at issue;

4. Identify the legal basis under EU or Member State law for the order;

5. Clearly explain why the UGC in question is illegal (including the specific provisions of EU or Member State law that the UGC violates);

6. Indicate the exact location or other information enabling the identification of the UGC at issue;

7. Identify any relevant Law Enforcement entity to which information about the effect given to the order is to be provided;

8. Identify the territorial scope of the order;

9. Include information about the redress mechanisms available to Take-Two and to the affected consumer(s) responsible for the UGC;

10. Submit on official letterhead and include a valid email address, telephone number, and contact name; and

11. Ensure the request is signed by an authorized representative of the issuing Law Enforcement entity.

Requirements – Trusted Flaggers:

1. Provide your name, email address, and explicitly identify your status as a trusted flagger under DSA Article 22 along with a link to the relevant public designation of that status;

2. Identify the Take-Two label or studio to which the notice relates;

3. Clearly explain why the UGC in question is believed to be illegal;

4. Identify the UGC in question and indicate the exact location or provide such other information as may be necessary to enable Take-Two to identify the location of the UGC in question;

5. Include the following statement in your notice: “I hereby confirm that I have a good-faith belief that the information and allegations contained in this report are accurate and complete”; and

6. Submit your notice to [email protected] using an official email address for the trusted flagger.

DSA Legal Representative:

Take-Two’s DSA legal representative varies by label and studio depending on the location of the applicable data controller for that label or studio:

• For data controllers located in the European Union, the legal representative is the data controller listed at www.take2games.com/labels.

• For data controllers located outside of the European Union, the legal representative is the EEA Representative listed at www.take2games.com/labels.

Send all orders issued pursuant to the DSA to the address of the applicable Take-Two DSA legal representative and a courtesy PDF copy by email to [email protected] from an official email address for the issuing Law Enforcement entity.

General Data Protection Regulation (“GDPR”)

Requirements:

1. Identify the Take-Two product or service at issue;

2. Direct the request to the data controller for the relevant Take-Two label or studio responsible for that product or service;

3. Provide reasonably detailed information regarding your inquiry, the data subject(s) to which the request relates, and the information sought from Take-Two in respect of such data subjects;

4. Submit the request on official letterhead and include a valid email address, telephone number, and contact name;

5. Ensure the request is signed by an authorized representative of the requesting Law Enforcement entity; and

6. Submit the request to the applicable data controller at its address listed at www.take2games.com/labels and email a courtesy PDF copy of the request to Take-Two’s data protection officer at the email address listed below using an official email address for the issuing Law Enforcement entity.
